Licence Agreement

This Direct Use Licence Agreement (“Agreement”) governs access to and use of Cityweft’s platform, plugins, and APIs by individual users and organizations using Cityweft data directly for design, visualization, and project work (“User”). By using Cityweft’s products or services, you agree to these terms.

1. Scope of Service

Cityweft provides access to 3D city models, terrain data, and related geospatial datasets derived from open and proprietary sources. Depending on your account or subscription type, your access may include:

  • Use of the Cityweft web platform, plugins, or API to view, export, or integrate 3D data.

  • Access to data for visualization, planning, competitions, or professional project work.

  • Access to updates and new features released during your active subscription period.

Cityweft acts as a value-added distributor and processor of open and proprietary geospatial data, offering unified access, model generation, and delivery through its platform.

2. Licence Grant

Upon lawful access through the Cityweft platform or API, you are granted a non-exclusive, non-transferable, worldwide, revocable licence to:

​

  • Use Cityweft data in your own projects, including commercial design, planning, visualization, and analysis work.

  • Incorporate visual representations or outputs derived from Cityweft data into presentations, reports, or client deliverables.

  • Store exported files for internal or project use, provided such storage remains compliant with this Agreement.

 

This licence is perpetual for any data lawfully exported or delivered during an active subscription period, provided the data was not obtained through breach of this Agreement.

3. Restrictions​

You may not:

​

  • Resell, sublicense, or distribute Cityweft data or any derivative of it as a standalone product.

  • Use Cityweft data to create derivative products for commercial sale, such as printed models, 3D assets, or downloadable content, without written permission from Cityweft.

  • Integrate Cityweft data into any external platform, software, or service intended for distribution or sale.

  • Circumvent usage limits, authentication measures, or licensing restrictions.

  • Misrepresent Cityweft data as your own or remove any attribution, watermark, or embedded identifiers.

 

4. Permitted Commercial Use

You may use Cityweft data for commercial projects — including architectural, urban planning, or consulting services — provided that:

  • The data is used as contextual or supporting material within a broader project or deliverable; and

  • The final output is not a standalone Cityweft dataset or derivative intended for resale.

 

5. Derivative Works

Derivative Works means any model, file, or dataset substantially based on Cityweft data, including simplified, remeshed, or retextured versions.

Derivative Works remain subject to this Agreement and may not be distributed, resold, or published without written authorization from Cityweft.

6. Intellectual Property Rights

Cityweft’s processing, aggregation, and formatting constitute value-added intellectual property.

All rights, title, and interest in the processed 3D models, API data, and platform infrastructure remain the exclusive property of Cityweft and its licensors.

You retain ownership of your own designs, renderings, and projects that incorporate Cityweft data, provided they do not involve redistribution or commercialization of the data itself.

7. Data Accuracy & Availability

  • Cityweft strives to maintain reliable data access and uptime but does not guarantee availability or accuracy.

  • Cityweft is not liable for errors or omissions in the underlying open data sources or for project outcomes derived from them.

7A. Open Data Sources

Cityweft’s datasets incorporate publicly available and open-source geospatial data from third parties. These sources are processed and enhanced by Cityweft to produce value-added 3D models.

Cityweft does not claim ownership of the underlying open data but retains ownership of all processed and aggregated outputs.

8. Termination

  • Either party may terminate this Agreement at any time.

  • Upon termination, access to Cityweft services may be revoked.

  • You may continue to use data obtained before termination for legitimate project purposes, provided it was lawfully accessed and not in breach of this Agreement.

 

9. Confidentiality & Security

  • Your account credentials and any associated API keys must be kept secure.

  • You are responsible for preventing unauthorized access to your Cityweft account or exported data.

 

10. Limitation of Liability

  • Cityweft provides its services “as is” without warranties not expressly stated.

  • Total liability is limited to the amount paid by you in the 12 months prior to the claim.

 

11. Governing Law & Jurisdiction

This Agreement shall be governed by Estonian law, with disputes subject to the exclusive jurisdiction of the courts in Tallinn, Estonia.

 

12. Open Data Attribution

Cityweft acknowledges and complies with applicable attribution requirements for all third-party open data used in its processing pipeline. Attribution information is available upon request and may vary by region and dataset.

 

13. Changes to This Agreement

Cityweft may modify this Agreement from time to time. Advance written notice will be provided for any material changes, and your continued use after the effective date constitutes acceptance.
